Why Having The Right Custody Representation Matters

Because custody can be legally and financially complex as well as emotionally draining, and because it often involves (or eventually leads to) conflict, it can be hard to see the forest for the trees – you may not be able to see past your stress, confusion, fears, and sadness in order to be able to make the right choices for your and your children’s futures.

However, making the right choices during this process is of the utmost importance. How custody is determined will affect not only your relationship with your children, but also their relationship with the other parent, their and your relationship with extended family members, their and your financial stability, their education and religious upbringing, and everyone’s emotional well-being.

That’s why it’s so important to enlist the guidance of a local custody attorney you trust to advocate for your interests every step of the way. Our skilled Austin custody lawyers can not only protect your parental rights, but can also give you wise legal counsel about every aspect of custody that will make a difference in how smooth your experience is.

Texas Custody At A Glance

Understanding custody in Texas is a major part of a custody dispute. The laws and procedures here in the Lone Star State can be confusing at times. For one, custody is referred to as conservatorship, and there are two categories: managing conservatorship (which refers to decision-making power) and possessory conservatorship (which refers to parenting time or visitation).

Texas courts prioritize joint conservatorship, and generally believe it is in a child’s best interests to have both parents play an active role in their life, though that doesn’t always mean the parents will spend an equal amount of time with the child (even in a joint conservatorship, one parent may still be labeled as the “primary” parent). In some cases, however, they will rule in favor of sole conservatorship if there is compelling evidence that a child’s safety or wellbeing are at risk.

In a sole conservatorship, the other parent is typically given visitation rights, which are outlined in a possession and access schedule. The Standard Possession Order (SPO) is the most common visitation arrangement, but it can be modified in some instances to better meet a family’s unique needs.

Our experienced Austin custody lawyers will always fight to protect your kids’ best interests! Whether we represent you in mediation and help guide you and your co-parent to a mutually-beneficial custody arrangement, or represent you in court while we aggressively advocate for the wellbeing of your family, your case is safe in our hands.

How Our Austin Custody Lawyers Are Different

It’s not selfish to want a beautiful life for you and for your kids – your vision of what you want you and your kids’ lives to be, look, and feel like is worth fighting for. At Hembree Bell Law, our goal is to help you achieve that vision! While many family law and custody firms are solely focused on the legal aspects of your case and arriving at a short-term solution, we are not just a firm that you use one time to solve one problem.

We understand that you may have a pressing legal need (and you can rest assured we will give all of our resources to resolving your legal issues effectively and cost-efficiently), but we want to be here for you for more than that. Building a life you love is a journey! If you need something like a custody arrangement modification or legal advice regarding another family law issue a year from now or ten years from now, our Austin custody lawyers will still be here to support and empower you.

That’s not the only thing that sets our firm apart! We never take a cookie-cutter approach to custody cases, because we know that your family dynamics are completely unique. We tailor everything we do for you to your exact needs. We also know that because your family is unique, you and your spouse are going to be the best people to make decisions about your family’s future because you know your family best!

Taking a collaborative, amicable approach always gives you the most control, rather than a judge and court system who don’t know you. It’s also usually the best approach in terms of how easy it is on you and the kids emotionally. However, if fighting can’t be avoided, we won’t hesitate to aggressively do so for you in court if necessary. We’ll fight hard but smart for your kids and your money.

Our Austin custody lawyers are people you will actually like – friendly, accessible, good communicators – and they have been in your shoes, so they can relate to you. Our firm’s founder, Hannah Hembree Bell, has navigated divorce and custody before in her own life. She has both the personal and professional knowledge to give you an advantage!

Frequently Asked Questions About Custody In Austin, TX

Does adultery have any impact on custody determinations?

Typically, no. The court’s main concern is the child’s best interests, so unless the cheating parent acted in a particularly egregious manner (such as conducting the affair in the presence of the child or neglecting parental responsibilities to pursue the affair) this will likely not have an impact on a custody case. For more info, see here

Do courts favor mothers over fathers?

No! This is not legal. Texas courts want both parents involved in a child’s life.

Who, if anyone, pays child support in a joint conservatorship?

In a joint conservatorship, the non-primary parent typically pays child support to the primary parent. In a 50/50 possession schedule, child support calculations can be more complex, but if one parent earns significantly more than the other, they will likely be required to pay child support.
